Can I grow marihuana at home in Macomb Township?
Personal cultivation under Michigan law is accommodated, with township conditions (Sec. 10.2609, Article XXVII, adopted 2021). Adults 21 and over and registered qualifying patients may cultivate for themselves on residentially zoned parcels (and industrial parcels) in an enclosed, locked facility accessible only to them. The township adds: no more than 100 square feet of the dwelling or an accessory structure may be used for growing, processing, and storage; building, electrical, plumbing, and mechanical permits are required for alterations; grow lighting between 11:00 p.m. and 6:00 a.m. must be shielded from neighbors; butane extraction inside a residence or its curtilage is prohibited; and renters need the property owner's written consent.
Registered primary caregivers operating for patients need an annually renewed Zoning Certificate to Cultivate Medical Marihuana with building, fire, and law enforcement inspections (Sec. 10.2611). The use must stay clearly incidental to living in the house (Sec. 10.2609.1.i).
