Can you live in a detached garage or accessory building in Birmingham, MI?
No. Birmingham's ordinance states plainly that residential occupancy of accessory buildings is prohibited (§ 4.02). This applies in all residential districts, and in the business, office, parking, and transitional districts as well.
That means a detached garage, pool house, or backyard studio cannot contain a bedroom, kitchen, or any living quarters, no matter how it is finished inside.
The one exception is the MX mixed-use district along the Eton Road corridor, where residential units in accessory structures are permitted (§ 4.07). MX is a small commercial corridor, not a single-family neighborhood.
If you want sleeping or living space beyond the main house, the realistic paths are an addition to the principal dwelling or a request for relief through the city. Call the Planning Division at 248-530-1850 before investing in plans.
