Can I put a 6 foot privacy fence on my property line in Orion Township?

As the ordinance is written, generally no. Orion Township allows two kinds of residential fences: lot enclosure fences on the lot line at up to 4 feet (Section 27.05.H.1), and privacy or decorative fences at up to 6 feet that may not be located within any required yard setback area (Section 27.05.H.2).

Your required setbacks run along the lot lines. In R-1, R-2, and R-3 that means 10 foot side yards and a 35 foot rear yard (Section 6.04), so a 6 foot privacy fence would need to stand inside those lines rather than on them.

Exceptions and outs:

  • Lots over 2 acres with at least 200 feet of frontage, not part of a recorded plat, are excluded from the fence rules (Section 27.05.H.4).
  • The Zoning Board of Appeals can modify fence and screening requirements by variance where that is consistent with the ordinance's intent (Section 30.07.C).

Many yards in the township have tall fences, and enforcement practice may differ from the strict text. Confirm with the Building Department at 248-391-0304 before building.
