How do I request a variance?
Variances go to the board of adjustment under Sec. 53-1198: five members, four concurring votes required. The board may vary yard and structural requirements where special conditions such as irregular lot shape or topography make literal enforcement an unnecessary hardship, but never as a mere convenience and never to allow a use the district does not permit. Special exceptions cover utility structures, district-line lots, and parking or loading reductions. Appeals of administrative decisions also go to the board and stay proceedings. Parking design standard variances instead go to the planning and zoning commission with appeal to the council (Sec. 53-33(n)(9)), and PUD deviations run through the PUD plan process (Secs. 53-702, 53-703). Kyle regulates zoning inside its incorporated city limits only; Texas counties do not zone, and the ETJ has no municipal zoning. Confirm the district, any overlay or PUD condition, and current ordinance text with the Kyle Planning Department before design, purchase, leasing, or permitting decisions.
