Can I grow marihuana at home in Shelby Township?
Personal cultivation is allowed with tight conditions. A registered qualifying patient or any adult 21 or older may use, possess, and grow marihuana for themselves in their principal residence on a residentially zoned parcel, but only inside an enclosed, locked facility inaccessible from all sides (Section 4.66.C). No more than 100 square feet of the dwelling or an approved accessory structure may be used for growing, processing, and handling, and any accessory building used must first pass building, electrical, mechanical, and fire inspections (Section 4.66.C.1.i).
No one other than the resident patient or adult may be involved, grow lighting visible from outside between 11:00 p.m. and 6:00 a.m. must be shielded, butane extraction indoors is prohibited, and renters need the property owner's written consent (Section 4.66.C.1.e, f, g, h).
Commercial-scale caregiver growing is banned in every district except L-M and H-M, where a registered primary caregiver may grow up to 72 plants in an enclosed locked facility at least 500 feet from any school, child care facility, place of worship, or public park (Section 4.66.D). As for marihuana businesses, the township permits only licensed grow operations in the industrial district; retail dispensaries are prohibited (Code of Ordinances Sec. 14-652, Ord. No. 304, March 4, 2025).
