What setback applies to the street side of a corner lot in Troy?
It depends on how your rear yard relates to the lot behind you (Section 4.06.D.3).
- Where a common rear-yard relationship exists with the adjoining lot, the street-facing side yard only needs to meet the district's normal side yard setback.
- Where that relationship does not exist, the street side must equal the full front setback of the district, and that yard counts as a front yard.
The difference is significant. In R-1B, for example, the side setback is 10 ft while the front setback is 40 ft (Section 4.06.C).
A front-yard classification also affects fences: only 30 inches of fence height is allowed in front of a front building setback line, though qualifying corner lots may run a 48 inch non-obscuring fence along the common street line (City Code § 83-2(A)).
