Can I add an accessory dwelling unit?
Chapter 53 has no general accessory dwelling unit provision. Residential districts permit accessory structures that do not involve a business (Sec. 53-64(7)), and Sec. 53-33(r) limits them to rear yards, half-height setbacks, 20 feet maximum height, and half the principal structure's aggregate floor area. Nothing in the residential divisions expressly authorizes a second dwelling unit on a single-family lot, and uses are noncumulative (Sec. 53-33(o)). Whether a guest quarters or secondary unit is approvable is a staff interpretation question, so ask the Planning Department directly, and note state ADU legislation may affect the answer. Kyle regulates zoning inside its incorporated city limits only; Texas counties do not zone, and the ETJ has no municipal zoning. Confirm the district, any overlay or PUD condition, and current ordinance text with the Kyle Planning Department before design, purchase, leasing, or permitting decisions.
