How long do I have to appeal a zoning decision in Birmingham?

The ordinance does not say, so ask the city. Birmingham's zoning ordinance states no filing deadline for appeals to the Board of Zoning Appeals, and no window for taking a BZA decision further. Rather than rely on an assumed number, get the current deadline from the city before you act. The Planning Division is at 248-530-1850.

What the ordinance does establish:

  • Appeals from Planning Board decisions go to the BZA (§ 7.29)
  • Appeals from Design Review Board decisions also go to the BZA (§ 7.31)
  • A BZA order lapses after 1 year unless a permit is obtained or the use is established (§ 8.01(G))

Treat timing as the first question you ask. Deadlines borrowed from other cities, older summaries, or general state-law guides may not match Birmingham's current practice, and a missed window can end an appeal before it starts.
