What are the setbacks for a deck or patio in Macomb Township?
Patios and decks are rear-yard construction: they may not sit in any required side yard setback, must keep at least 7.5 feet from the side property line and 20 feet from the rear property line, and their walls and railings may not rise more than 42 inches above the finished floor of the deck (Sec. 10.0311.E.6.b). Nothing may be built in a recorded easement (Sec. 10.0311.E.6.e).
A roof changes the analysis: covered patios, gazebos, pergolas, and pavilions are separately regulated open-air structures, allowed at up to 12 feet high at the same patio and deck setbacks, with no separation required from the house or pool; they do not count against your accessory building allowance but do count toward lot coverage (Sec. 10.0356). Decks themselves are exempt from the lot coverage percentage in the single-family districts (Sec. 10.0704.E). Privacy screens around a deck may reach 6 feet but stay 3.5 feet off side and rear lines (Code of Ordinances Sec. 14-27.a.7).
