How long do I have to appeal a zoning decision in Troy, and how long is a variance valid?
You have 30 days. An administrative appeal to the Zoning Board of Appeals must be filed in writing within 30 days of the written decision (Section 15.04.C.1). Miss the window and the decision stands.
On the other side of the process, two clocks govern a variance after the ZBA acts:
- A granted variance is valid for 1 year (Section 15.05.A). Act on it within that time or it expires.
- A denied application is barred for 1 year. The ZBA will not rehear the same request within a year unless new evidence is presented (Section 15.05.A).
The practical advice follows directly. If you receive an adverse written decision, calendar the 30 day deadline immediately. If you win a variance, pull permits and begin within the year.
For ZBA hearing dates, check the city's posted meeting schedule. Filing questions go to the Planning Department at 248-524-3364.
