Does Apex zoning apply to my property if I am outside the town limits?

It may. North Carolina Chapter 160D lets municipalities zone their extraterritorial jurisdiction (ETJ) as well as their corporate limits, and Apex does this: Sec. 1.4.1 of the UDO applies the ordinance to all land within the Town's corporate limits AND its ETJ, with one carve-out for a small area assigned to the Town of Cary's zoning jurisdiction under a 1969 boundary agreement between the two towns. The Board of Adjustment has seats allocated proportionally between Town and ETJ population (Sec. 2.1.3), which is further evidence the ETJ is actively zoned rather than just claimed on paper. If your property is inside the ETJ, the same UDO districts, dimensional standards, and use rules in this pack apply. If it is outside both the corporate limits and the ETJ, Apex has no zoning authority over it. Confirm ETJ status for a specific parcel with Planning and Community Development at 919-249-3426.
