Can I build an in-law suite in Troy, Michigan?

It depends on whether the suite becomes a second dwelling unit. Troy allows one single-family or two-family dwelling per lot (Section 7.02.B.1), and the ordinance has no accessory dwelling unit category.

  • An in-law area that stays part of the single dwelling, such as a bedroom and bath wing the household shares, is mainly a building permit question.
  • A self-contained second unit with its own separate living quarters is not permitted on a one-family lot. The same applies to a detached guest house used as a dwelling.

The line between an addition and a second unit is fact-specific, so describe your plans to the Planning Department at 248-524-3364 before designing.

If a true second unit is the goal, the route is a use variance, which requires an unnecessary hardship showing and a two-thirds vote of the Zoning Board of Appeals (Section 15.04.F), or rezoning. Neither is routine.
