How do I request a variance?
Apply to the Board of Adjustment under UDO Sec. 15.13. The variance process provides limited relief from a specific requirement where strict application would create a practical difficulty or unnecessary hardship that prohibits an otherwise-allowed use of the land. Among the required findings, the Board must determine that carrying out the strict letter of the ordinance would create an unnecessary hardship, that the hardship results from conditions peculiar to the property such as location, size, or topography, and that the hardship was not created by the applicant's or owner's own actions. Approval requires a concurring vote of four-fifths (4/5) of the Board of Adjustment, a higher bar than a simple majority. The Board may attach conditions, and a record of all variance actions is kept.
