Variances are heard by the Board of Adjustment. The variance process is intended to provide limited relief from a specific requirement where strict application would create a practical difficulty or unnecessary hardship that prohibits an otherwise-allowed use of the land. The Board must find, among other things, that carrying out the strict letter of the ordinance would result in an unnecessary hardship, that the hardship results from conditions peculiar to the property (such as location, size, or topography), and that the hardship did not result from the applicant's or owner's own actions. Approval requires a concurring vote of four-fifths (4/5) of the Board of Adjustment. The Board may attach conditions to an approval. A record of all variance actions is maintained, and decisions may be appealed.
