How do I request a variance in Surprise?
A variance is a Type 3 application (Sec. 102-6.5) heard at the discretion of the Board of Adjustment. Only dimensional relief is available, never a variance to permitted uses, density, or a decrease in minimum lot area. The Board must find both the state-law hardship criteria (A.R.S. Sec. 9-462.06) and five local criteria: preexisting special circumstances specific to the property, not self-imposed by the owner; that the variance is necessary to preserve substantial property rights; that it will not be materially detrimental to neighbors or public welfare; and that it does not grant a special privilege. A granted variance becomes void if a building permit application is not submitted within 6 months. Smaller dimensional relief may separately be available through an administrative waiver, a Type 1 application under Sec. 102-4.6.
