How do I request a variance in Queen Creek?
Apply to the Board of Adjustment (BOA) under Sec. 3.7. A variance is not a right: under Arizona law (A.R.S. Sec. 9-462.06), no use variance and no variance based on a self-imposed hardship can be granted. The Board must find special circumstances unique to the property (size, shape, topography, or location), that literal enforcement would deny the owner rights enjoyed by similar properties in the same district, and that granting the variance confers no special privilege. An approved variance must be exercised within 1 year unless the Board sets a different limit. Appeals of an administrative decision must be filed with the Planning Administrator within 30 days of the decision.
