All districts

The Board of Adjustment (BOA) hears appeals of administrative decisions and variance requests (Sec. 3.7.A). A variance is not a right; under A.R.S. Sec. 9-462.06, no use variance and no variance based on a self-imposed hardship may be granted. The Board must find special circumstances unique to the property, that literal enforcement would deprive the owner of rights enjoyed by similar properties in the district, and that the variance grants no special privilege (Sec. 3.7, Approval Criteria). An approved variance must be exercised within 1 year unless the Board sets a different limit (Sec. 3.7.B.3). Appeals of an administrative decision or interpretation must be filed with the Planning Administrator within 30 days of the decision (Sec. 3.7.B.1).
