How do I request a variance?
Apply to the zoning board of adjustment under Sec. 82-34. Variances are limited to height, yard, lot area, exterior structure, lot coverage, off-street parking, and loading requirements. The board must find the variance is not contrary to the public interest, does not violate the ordinance's intent, observes its spirit while doing substantial justice, will not injure or restrict development on other property, is not sought merely for economic gain, and addresses an unnecessary hardship tied to the parcel itself (not self-created or personal to the owner). Any preliminary or final site plan or plat for the property must be finally acted on before the variance is heard, and granting one requires a concurring vote of 75 percent of the board.
