PD — Planned Development district

Changes to PD standards run through the zoning amendment process for that PD (conceptual plan and development/detailed site plan approval, Sec. 82-25(d)-(g)), not a board of adjustment variance. All requested variances from standard requirements must be listed in the original PD application; applications without this list are considered incomplete.

All districts

The zoning board of adjustment may grant variances only for height, yard, lot area, exterior structure, lot coverage, off-street parking, or loading (Sec. 82-34(a)(1)). The board must find the variance is not contrary to the public interest, does not violate the ordinance's intent, observes its spirit while doing substantial justice, will not injure or restrict development on other property, is not sought merely for economic gain, and addresses an unnecessary hardship from a restrictive parcel (area, shape, or slope) that is neither self-created nor personal to the owner. A preliminary/final site plan or plat must be finally acted on before a variance is heard, and a concurring vote of 75 percent of the board is required to grant one (Sec. 82-34(b)(4), citing V.T.C.A. Local Government Code Sec. 211.009(c)).
