How do I request a variance?
File a variance application with the Development Services Department for hearing by the Zoning Board of Adjustment, which can vary numerical and dimensional standards in the land use and site design chapters; City Council handles variances to subdivision standards (UDC 10.203.24.2). You must satisfy all findings: unique physical conditions on the parcel, deprivation of rights commonly enjoyed, harmony with the code and plans, conditions not self-created, no special privilege, and the minimum relief necessary. Use variances are not available, and personal or economic hardship, contractor errors, and visibility concerns are expressly not grounds. In the OT and FBC districts, ask about the minor modification process instead (UDC 10.203.9). Approved variances generally run with the land.
