PUD — Planned Unit Development

Changes to PUD standards generally run through the planned unit development procedures (UDC 10.203.13) rather than a variance, because PUD standards are ordinance-level. Variances under UDC 10.203.24 address dimensional hardship on individual parcels and cannot be used to change permitted uses. Confirm the right instrument with Development Services before filing.

All districts

The Zoning Board of Adjustment grants variances to numerical or dimensional standards in the land use and site design chapters and hears appeals of staff decisions; City Council grants variances to subdivision standards (UDC 10.203.24.2). All findings must be met: unique parcel conditions, deprivation of rights commonly enjoyed, harmony with the code and plans, conditions not self-created, no special privilege, and minimum necessary relief. Use variances are not available, and personal or economic hardship is not grounds (UDC 10.203.24.3). In the OT and FBC districts a separate minor modification process applies (UDC 10.203.9).
