How do I request a variance?

Variance requests go to the Board of Adjustment (Sec. 1-2-7, Sec. 1-3-3). The Board must find special circumstances tied to the property itself (size, shape, topography, location, or surroundings) that were not self-created, that strict application of the Ordinance would deny privileges enjoyed by similar property in the same district, and that the variance will not harm the surrounding area or grant a special privilege. After a public hearing, a simple majority vote of the Board grants the variance, which cannot change the district's permitted use or density and expires after 12 months unless construction starts or a single 12-month extension is obtained. Special Use Permits and rezonings follow a related but separate City Council process under Sec. 1-3-1 and Sec. 1-3-4. Confirm current details by calling Development Services at 623-932-3004.
