Variance requests go to the Board of Adjustment (Sec. 1-2-7). The Board must find, on sufficient evidence, all of: special circumstances applicable to the property (size, shape, topography, location, or surroundings) that were not self-created by the current or a former owner; that strict application of the Ordinance would deprive the property of privileges enjoyed by similarly classified property in the same district; and that the variance will not be materially detrimental to the vicinity or grant a special privilege inconsistent with limitations on other nearby property. A variance cannot change a district's permitted use or density. After a public hearing under Sec. 1-3-9, a variance is granted by the concurring vote of a simple majority of the Board and expires 12 months after grant unless a building permit issues and construction starts, or a single 12-month extension is obtained (Sec. 1-3-3, Am. Ord. 22-1551, passed 8-29-22).
