How do I request a variance in Forney?

Apply to the Board of Adjustment (BOA) under Sec. 9. The Board can grant a variance only if it is not contrary to the public interest, literal enforcement of the Ordinance would create an unnecessary hardship due to special conditions unique to the property, and the spirit of the Ordinance is preserved (Sec. 9.4.A.2). A variance, like most BOA actions, needs a concurring vote of at least 75 percent of the full Board, which is 4 of the 5 members (Sec. 9.3.A, Sec. 9.4.C). The Board also hears appeals of administrative decisions and disputes over zoning district boundary interpretation.
