The Board of Adjustment (BOA) hears variance requests and must find the variance is not contrary to the public interest, that literal enforcement would cause unnecessary hardship due to special conditions, and that the spirit of the Ordinance is observed (Sec. 9.4.A.2). Approval, and most BOA actions, require a concurring vote of at least 75 percent of the full Board, defined as 4 of 5 members (Sec. 9.3.A, Sec. 9.4.C). The Board also hears appeals of administrative decisions and interpretations of zoning district boundaries.
