How do I request a variance?
Variances are decided by the Zoning Board of Adjustment under Sec. 11.06.122. File a written request at least 30 calendar days before the board meeting, with documentation showing how you satisfy every hardship criterion: special conditions unique to the property (lot size, shape, topography, or similar), an undue hardship from strict application that is not self-induced and not purely financial, no harm to the character or use of nearby property, and consistency with the public interest and the spirit of the chapter. The board must hold a public hearing, with mailed notice to owners within 200 feet and newspaper notice at least 10 days ahead, and it may attach conditions to an approval. Use variances are prohibited; a variance cannot authorize a use the district does not allow. Appeals of staff decisions follow Sec. 11.06.121 and Texas Local Government Code chapter 211.
