How do I request a variance?
Apply to the Board of Adjustment through the Director (Sec. 9.04.053(a)). The Board can grant relief from the ordinance's terms only in specific cases of hardship, under Texas Local Government Code Sec. 211.009(a)(3). The city mails notice to the petitioner and to property owners within 200 feet of the subject lot, then holds a public hearing. Approval, denial, or conditional approval needs 4 of the 5 Board members to concur. The Board cannot approve a variance unless it finds the variance is not contrary to the public interest, that literal enforcement of the ordinance would cause unnecessary hardship from special conditions unique to the property, and that the spirit of the ordinance is observed with substantial justice done.
