The Board of Adjustment may authorize a variance from the zoning ordinance's terms in specific cases of hardship (Texas Local Government Code Sec. 211.009(a)(3)). Applications are filed with the Director. Mailed notice goes to the petitioner and to owners of property within 200 feet of the subject lot, plus a public hearing. Approval, denial, or conditional approval requires the concurring vote of 4 of the 5 Board members. The Board may not approve a variance unless it finds the variance is not contrary to the public interest, that literal enforcement would cause unnecessary hardship due to special conditions, and that the spirit of the ordinance is observed and substantial justice is done.
