Does the Live Local Act change what I can build here?

Yes. Miramar has its own Live Local Act implementing ordinance, Sec. 409 of the LDC (adopted by Ord. No. 25-02, effective 10-16-24), which applies the 2023 Live Local Act (F.S. Sec. 166.04151(7), as amended by Chapter 2023-17 and 2024-188, Laws of Florida) directly in the code rather than leaving it to state law alone. A qualifying development must be a mixed-use multifamily project with at least 65 percent of gross square footage residential, at least 40 percent of residential units affordable for a minimum of 30 years (F.S. Sec. 420.0004), and a minimum of 10 percent of total square footage in non-residential use (Sec. 409.5-409.6). Qualifying developments are authorized administratively in the CR, B1, B2, B3, OP, EC, PID, TND, MH, and ML districts, plus three Transit Oriented Corridor districts named explicitly in Sec. 409.5: TOC-MH (Mixed-Use High), TOC-ML (Mixed-Use Low), and TOC-SD1 (Special District 1 only; TOC-SD2 and TOC-SD3 are not listed and are not eligible). Density is capped at the highest density allowed by right anywhere in the city (25 dwelling units per acre, per Sec. 409.6.1(a)), and height is set to the highest currently allowed height for a commercial or residential building within 1 mile of the site, or 3 stories, whichever is greater (Sec. 409.6.4(c)), except where the site is adjacent on two or more sides to an established single-family subdivision of at least 25 contiguous homes, in which case height is capped at 150 percent of the tallest adjacent building or 3 stories, whichever is greater (Sec. 409.6.4(b)). Because this is state-preemption legislation, it can apply to a property even where a code is silent about it; Miramar's code is not silent, but always confirm the current version of F.S. Sec. 166.04151 for any recent state-level amendment, since the Act is subject to legislative change and a 2033 sunset under its own terms (Sec. 409.10).
