Can a church or private school open in a Birmingham residential neighborhood?

Yes, but only with a special land use permit. In the single-family districts (R1A, R1, R2, R3), religious institutions and private schools are listed as special land uses, not permitted uses. Public schools, by contrast, are permitted outright.

Approval runs through two bodies. The Planning Board reviews the site plan and design and makes a recommendation (§ 7.34). The City Commission then makes the decision (§ 7.33). Neighbors within 300 ft receive mailed notice, and notice is also published and posted (§ 7.35). The Commission applies six standards covering compatibility and impacts (§ 7.36).

If owners of 20 percent of the land within 300 ft file a protest petition, approval needs a five-sevenths Commission vote (§ 7.35). Expect parking, traffic, and site design to drive the review. The Planning Division can outline the submittal: 248-530-1850.
