Can I build an accessory dwelling unit?

Yes, in most residential and mixed-use districts, subject to UDO Sec. 3.2.3. Only one accessory dwelling is permitted per lot. A detached accessory dwelling must be sited to the side or rear of the principal building and must be clearly subordinate in size to the main structure; Sec. 3.2.3 does not set a separate numeric square footage or height cap beyond that subordination standard. Per the Town's homeowner permit guidance (a separate source from Sec. 3.2.3 itself), the unit must include a complete kitchen and full bathroom, needs one off-street parking space, and may not display any sign visible from the street or sidewalk. Accessory dwellings are allowed for detached-dwelling lots in RD, GR3, GR5, GR10, ICD, UR, RMX, RA HC, NMX, UMX, and PUD. Confirm your district and any building-permit-level dimensional limits with the Planning Department at 919-435-9510 or the online development permit application before building. This pack covers the July 2022 UDO, the version currently in force.
