Can I build a shed or detached garage?
Yes, subject to UDO Sec. 4.6 and the base district's setback and height standards. Accessory structures may only be placed in the side or rear yard, not the front yard, and must be at least 30 feet from a right-of-way. They cannot be used as a dwelling unless approved as an Accessory Dwelling Unit under Sec. 3.2.3. Per the Town's homeowner permit guidance, a structure 12 feet by 12 feet or smaller needs only a development permit, while a larger structure needs a building permit; size is capped at 600 square feet per structure on lots under 1 acre, or 1,000 square feet aggregate on lots from 1 to 3 acres. Setbacks for the accessory structure follow the same district chart as the principal building (for example, 5 to 10 feet side/rear in most residential districts, per UDO Sec. 2.2.3 and Sec. 2.2.5). Confirm your district and lot size with the Planning Department at 919-435-9510 before building.
