Can I build a fence?
Yes, and no permit is required, either inside Fuquay-Varina's corporate limits or in its extraterritorial jurisdiction (ETJ), but the fence still has to meet the Town's standards under LDO Sec. 9-1303. Inside corporate limits, front-yard fences are capped at 4 feet (opaque fences are prohibited in the front yard), and side/rear yard fences at 6 feet. In the ETJ, there is no maximum fence height in the side or rear yard. Keep the fence at least 3 inches inside the property line (adjoining owners can consent in writing to place it on the line instead), and give privacy fences a 2-inch gap at the base for stormwater drainage. Fences in a landscaping or buffer easement must sit 8 feet from the rear property line, and fences are never allowed in a dedicated easement for any purpose. Confirm whether your parcel is inside Town limits or the ETJ with the Planning Department at 919-552-1429 before building.
