No permit is required to install a fence, either inside corporate limits or in the ETJ, but fences must still meet the Town's standards. Inside corporate limits: maximum 4 feet in the front yard (paralleling the front property line or right-of-way line and along the side property lines to the front plane of the principal building; opaque fences are prohibited in the front yard), and maximum 6 feet in the side or rear yard. In the ETJ: there is no maximum fence height in the side or rear yard. Fences must be installed with the finished surface facing out to a public street or adjacent property; chain-link must be covered with black or green plastic coating inside corporate limits, while no fence material is prohibited in the ETJ. Fences should be set at least 3 inches inside the property line (property owners on both sides of the line may instead consent in writing to placement on the line itself), and privacy fences need a 2-inch clearance at the base for stormwater drainage (inside corporate limits this clearance applies to all fences except masonry, hedges, chain-link, and split rail; in the ETJ it applies to privacy fences only). Fences in a landscaping/buffer easement regulated by Article O must be set 8 feet from the rear property line. Fences are never permitted within a dedicated easement for any purpose.
