The Board of Adjustment may grant a variance from strict application of the zoning provisions where literal enforcement causes unnecessary hardship due to unique lot conditions, and where the variance is the minimum relief necessary. A concurring vote of 75 percent or more of the Board is required; the Board must decide within 60 days of the public hearing. The variance cannot be granted solely to mitigate financial hardship, cannot result from the property owner's own prior actions, and must not be contrary to the public interest. Mailed and published notice are both required before the hearing.
