Special land uses in Forney, TX

What the Forney zoning ordinance says about special land uses, district by district. Section numbers link to the official ordinance.

PD — Planned Development (overlay)

A PD application specifies its base district(s) and permitted uses; anything not specifically permitted by right or Conditional Use Permit in the base district(s) or the PD ordinance itself is prohibited unless the PD ordinance is amended (Sec. 34a.2). Dimensional standards, unless the PD ordinance states otherwise, follow the stated base district(s) (Sec. 34a.3.B). Always pull the specific PD's adopting ordinance; Appendix A-1 lists over 40 named PDs by ordinance number, but the GIS zoning layer also shows PD parcels (for example IPTPD, Ord. 24-19) not in that Appendix A-1 list, so the appendix should not be treated as exhaustive.

CUP — Conditional Use Provision (overlay)

A Conditional Use Provision (CUP) is required before any use marked "C" in the Sec. 37.2 Use Chart may operate; no building permit may issue for a conditional use until the CUP is approved (Sec. 34b.1.B). The CUP application requires a concept plan or detailed site plan.

CBT — Central Business Transition (overlay)

Base district use and dimensional standards apply (lot size, yards, coverage, FAR, parking are all "as required in the base zoning district"); the overlay adds architectural standards intended to visually connect the corridor to the adjacent CBD.

ENT — Entertainment (overlay)

Base district use and dimensional standards apply. Unlike the base district, on-premise consumption of alcoholic beverages is a permitted use in ENT, subject to Sec. 34d.5 and Code of Ordinances Ch. 4, Sec. 10.

HOZ — Historic Overlay Zone

Base district regulations apply except where HOZ standards conflict, in which case HOZ controls (Sec. 34e.2). Property in the original HOZ boundary (Exhibit A) may not be removed from the overlay, and once added, later-included property also cannot be removed.

All districts

The Sec. 37.2 Use Chart marks each land use permitted by right (P), conditional (C, requires a Conditional Use Permit under Sec. 34b), or prohibited (blank) in each district; a use not listed in the chart at all is prohibited in every district (Sec. 37.1.B). New or unlisted uses are classified through a Planning and Zoning Commission recommendation and City Council action (Sec. 37.1.D).

All districts

Newly annexed property is zoned interim Agricultural (AG) until the City Council formally assigns a permanent district, a process that must begin within 180 days of annexation (Sec. 6.1). No building permit may issue for anything beyond an AG-permitted use until the property receives a permanent zoning classification (Sec. 6.4.A).
