All districts

The Board of Adjustment may grant a Zoning Variance from open space and yard dimensions, lot dimensions, floor area, structure height, building coverage, and other Section 2 requirements without an alternative approval path. Approval requires a public hearing under Sec. 2.10.04 and findings of unique circumstances, minimum necessary relief, preservation of property rights, no substantial public detriment, orderly land use, and undue hardship that is not self-imposed; financial hardship alone does not qualify. The Board cannot authorize a use not permitted in the district, cannot modify an SUP, and cannot act while a rezoning or plat on the property is pending. A concurring vote of 75 percent of Board members is required under Texas Local Government Code 211.009(c). Applications are processed by the Development Services Director. Sec. 2.11.01 Alternative Compliance and Sec. 2.11.04 Special Exception are separate, narrower relief paths.
