Who approves a special land use in Canton Township?

The Township Board of Trustees makes the final decision; the Planning Commission holds the public hearing and recommends (Section 27.03.B). That is worth knowing because in many neighboring communities the Planning Commission decides special land uses itself. In Canton the sequence is:

1. Preliminary site plan and application to the Planning Official, reviewed by the staff development review committee (Section 27.03.B.5, 6). 2. Revised plan submitted at least 35 days before the Planning Commission meeting (Section 27.03.B.7). 3. Public hearing at the Planning Commission, noticed 15 days ahead in the newspaper and by mail to owners and occupants within 300 feet (Section 27.03.B.8; Section 27.13.B). 4. Planning Commission recommendation of approval, approval with conditions, or denial (Section 27.03.B.10). 5. Township Board decision, at least 11 days after materials are submitted, with authority to hold further hearings and attach conditions (Section 27.03.B.11, 12).

Each special land use also carries its own conditions from the district article and Article 6.00, from lot sizes for accessory apartments to frontage minimums for drive-throughs, so read those before the application goes in. Site plan review rides along with the request (Section 27.02.B.1.e).
