How do I request a variance?

Apply to the Board of Adjustment, a five-member board appointed by Town Council, which hears variances of height, yard, area, exterior structure, lot coverage, and off-street parking requirements (UDC 1.02.C.4.d.iv). Approval takes a concurring vote of 4 of the 5 members (UDC 1.02.C.4.e). The Board must find the variance is not contrary to the public interest, that literal enforcement of the UDC would cause undue or unnecessary hardship, that the hardship was not self-created, and that special conditions specific to the parcel (restricted area, shape, topography, or physical features) are not shared by other parcels in the same district. A variance cannot authorize a use the district does not otherwise permit, and it cannot be heard until any required Preliminary Site Plan, Site Plan, Preliminary Plat, or Final Plat process is finished (UDC 1.02.C.4.d.v). Property inside a Planned Development District generally amends the PD's granting ordinance rather than seeking a variance (UDC 2.05.E). Start by confirming the zoning district on the Town's MapLink zoning map (pr6834.zoninghub.com/zoningmap.aspx) or with the Planning Division at 972-346-3502. This pack covers incorporated Prosper only; the ETJ and unincorporated Collin or Denton County land have no municipal zoning.
