How do I request a variance?
Submit a variance application with required fees, documents, and plans to the Building, Planning and Zoning Department (Sec. 315.2). Variances affecting an individual single-family or duplex dwelling are decided by the Planning and Zoning Board; all other variances go to the City Commission (Sec. 315.3). Staff and the Development Review Committee review the request and prepare a staff report before the public hearing (Sec. 315.4-315.6). You must show, by a preponderance of the evidence, either an undue hardship (as distinguished from mere inconvenience) or, failing that, a practical difficulty under the criteria in Sec. 315 (Sec. 315.19 covers zoning relief specifically). A use variance, meaning a request to allow a use not otherwise permitted in the district, is prohibited outright (Sec. 315.1). Miramar's LDC does not have a separately named Board of Adjustment; the Planning and Zoning Board (Sec. 107) fills that role for single-family and duplex variances.
