How do I request a variance in Maricopa?
Unlike many Arizona cities that use a board of adjustment, Maricopa's variance authority rests with a hearing officer (MCC Chapter 18.160). Variances may only be granted for dimensional and performance standards, never for use regulations (use variances are prohibited, MCC 18.160.070). The hearing officer reviews the zoning administrator's recommendation and holds a public hearing before approving, conditionally approving, or denying the request (MCC 18.160.050). No variance may be granted for a hardship the owner created (MCC 18.160.030), and the applicant carries the burden of proving the required findings, including that the special circumstances are preexisting and not self-imposed (MCC 18.160.060).
