How do I request a variance?
Apply to the board of adjustment under Sec. 106.02.02(g). You must show special conditions peculiar to the land or structure that do not result from your own actions, that a literal reading of the ordinance would deny you rights commonly enjoyed by similar properties in the district, and that the variance grants no special privilege denied to others in the same district or area. A public hearing is required, and the board must find the variance is the minimum needed for reasonable use and will not harm the neighborhood. The board may not grant a variance for a use that is not permitted in the district. Start by confirming the zoning district with Development Services (Town Hall, 2nd Floor, 100 W.
