How do I request a variance in Buckeye?
Apply for a Variance, decided by the City's Hearing Officer rather than a multi-member board (Sec. 8.12). You must show that strict application of the Development Code creates a practical difficulty or unnecessary hardship preventing an otherwise-allowed use of the land, that special circumstances tied to the property itself (size, shape, topography, location, or surroundings) deprive it of privileges enjoyed by similarly classified property nearby, and that those circumstances were not self-created. The Hearing Officer must also find the statutory conditions in A.R.S. Section 9-462.06.G.2 and H.2 are met. A Variance not utilized within two years becomes void with no extensions. A Variance cannot authorize a use the district does not otherwise allow. For smaller relief, up to 15 percent from a lot size, setback, or other numerical standard, ask about a Minor Modification instead, which the Zoning Administrator can approve administratively under Sec. 8.13 without a hearing.
