How do I get a zoning variance in Shelby Township?
Apply to the Planning and Zoning Department with the fee, a site plan at 1 inch = 20 feet showing the dimensional elements you need varied, and a letter of intent explaining how your request meets the standards (Section 7.16.E.1 to 3). If the variance arises from a site plan or sign application, the Planning Commission must consider that application first.
The Zoning Board of Appeals hears the request at its next regular meeting, or within 45 days of receipt, and decides by a concurring majority vote, with the written decision issued within a week (Section 7.16.E.5, 6; Section 7.16.C). The ZBA weighs eight factors under a practical difficulties standard: a condition unique to the property, not self-created, that makes strict compliance unreasonably burdensome, without granting a special privilege or injuring neighbors, and where a lesser variance would not suffice (Section 7.16.E.7). Personal or economic hardship alone does not qualify.
Only dimensional variances are available: height, area, setbacks, yards, parking modifications. A variance cannot establish a prohibited use, and no variance may be sought for an approved special land use, PUD, or C-6 project (Section 7.16.E; Section 6.4.F). If denied, appeal lies to Macomb County Circuit Court (Section 7.16.D.1.c).
