How do I get a variance in Novi?
Variances go to the Zoning Board of Appeals, a seven-member body appointed by City Council (Section 7.10.1). File a notice of appeal with the ZBA and the official whose decision you are appealing within 30 days, pay the fee, and the ZBA holds a public hearing (Section 7.10.3; Section 7.10.4).
For a dimensional variance, a smaller setback, taller fence, or extra lot coverage, you must show a practical difficulty on the record (Section 7.10.5.A.ii.a): the need arises from unique physical conditions of the property such as narrowness, shallowness, shape, water, or topography, not from your own actions; strict compliance would unreasonably prevent use of the property or be unnecessarily burdensome; the variance requested is the minimum that does substantial justice; and granting it will not harm surrounding properties or the neighborhood.
A use variance, running a use the district does not allow, demands the stiffer showing of undue hardship, including proof the property cannot reasonably be used for any permitted use (Section 7.10.5.A.ii.b). Those are rarely granted. Before filing, ask the Community Development Department whether a Planning Commission setback modification or an administrative path fits your situation better; some districts have their own flexibility built in (Section 3.6.2.Q).
