How do I get a zoning variance in Canton Township?
Dimensional relief runs through the Zoning Board of Appeals, and the first rule matters most: use variances are prohibited (Section 27.05.D.1). The ZBA can bend development standards such as setbacks and heights, never the list of allowed uses. If the ordinance offers a built-in modification for your standard, you must be denied that modification before applying (Section 27.05.D.2).
The ZBA must find all seven criteria true (Section 27.05.D.3): strict application would cause a practical difficulty; the difficulty stems from a physical condition peculiar to your property; it is not self-created; the variance is the smallest reasonable amount; no harm to public health, safety, and welfare; no substantial adverse effect on nearby use or value; and consistency with the ordinance's intent.
Mechanics: applications go through the Community Planner with a public hearing noticed 15 days ahead by newspaper and 300 foot mailing (Section 27.13.B). Staff may require you to stake the proposed structure and lot corners 15 days before the hearing (Section 27.05.G.5). Approval needs a concurring vote of three ZBA members (Section 27.05.G.7).
