How do I apply for a zoning variance in Macomb Township?

File with the Planning Department, which staffs the Zoning Board of Appeals (Sec. 10.2406.A). Your application needs the fee, a site plan drawn between 1 inch = 20 feet and 1 inch = 50 feet showing the dimensional elements you want varied and the relationship of your lot to structures on adjacent properties, and an affidavit addressing four points: why strict compliance with the area, setback, frontage, height, bulk, or density rules would unreasonably prevent a permitted use or be unnecessarily burdensome; how the variance does substantial justice to you and your neighbors; whether a lesser relaxation would give substantial relief; and how the spirit of the ordinance stays observed (Sec. 10.2406.B-C).

The township publishes notice and mails it to owners and occupants within 300 feet at least 15 days before the hearing (Sec. 10.2406.D). A concurring majority of the Board is required to grant relief, decisions are recorded with the grounds stated, and further appeal goes to Circuit Court (Sec. 10.2405). Fence variances use the separate hardship standard in Code of Ordinances Sec. 14-29. Application packets are available from the Planning Department at 54111 Broughton Road, 586-992-0710.
