How do I appeal a zoning decision in Ferndale?

Appeal to the Board of Zoning Appeals within 30 days of the decision. For decisions by a public body, the 30 days run from approval of the minutes (Section 19.09). The BZA hears appeals from the CED Director, the Building Department, and the Planning Commission, but not special land use or PUD decisions, which City Council controls (Section 19.04.D).

Key procedural points (Section 19.09):

  • Filing an appeal stays proceedings unless there is imminent peril
  • The BZA must issue a written decision within 14 days
  • A denied matter faces a 1-year resubmission bar
  • BZA decisions are final; further appeal goes to circuit court within 30 days

Sign decisions also appeal to the BZA under Section 8.09; the code's cross-reference there to Article 17 is an error, the BZA is established in Article 19. For hearing dates, check the city's posted meeting schedule or call CED at 248-336-4370.
