Can I run a daycare from my home in Rochester Hills?
Running a day care center on residential property in Rochester Hills requires conditional use approval from City Council. Nursery schools and day care centers are marked C, conditional, in the residential districts RE through R-4 (§ 138-4.300, Table 4), with use standards in § 138-4.420.
The process (§ 138-2.301):
- The Planning Commission holds a public hearing and makes a recommendation.
- City Council decides, with written findings against the standards in § 138-2.302.
- A denial carries a 365 day resubmission bar absent new evidence. An approval lapses after 365 days unless the use is established, with one 180 day extension available.
Council conditional use decisions cannot be appealed to the Zoning Board of Appeals (§ 138-2.301.F). Contact Planning and Economic Development at 248-656-4660 before applying.
