Do I need a Special Use Permit for my use?

Check the designation for your use in the district column of the UDO Sec. 2.3.3 use table. A "P" means the use is permitted by right; "SUP" means it needs Board of Commissioners approval of a Special Use Permit under Sec. 15.10; "A" means the use is allowed only as an accessory to a permitted primary use; "CZ" means it requires Conditional Zoning approval; and a dash means the use is not allowed in that district without a rezoning. The SUP process under Sec. 15.10 does not grant variances from any other ordinance requirement, so the proposal must independently meet every other applicable standard. Before approval, the Board of Commissioners must find that the proposed use: conforms to the neighborhood's character; will not cause undue traffic congestion or a traffic hazard; has adequate utilities available; will not be noxious or offensive by vibration, noise, odor, dust, smoke, or gas; will not impede orderly development of surrounding property; will not endanger public health, safety, or welfare; will not substantially injure adjoining property values; and is consistent with the Town's adopted plans and policies. The Board must act within 65 days of the public hearing or the application is deemed approved.
